If you are considering making a work accident claim, we understand you may have a number of concerns. Work Accident Solicitors want you to feel comfortable before you begin the claims process. That is why below we have explored some of the most common worries potential Claimants ask us, helping to give you confidence that by making a claim, you won't end up facing a series of unwelcome circumstances.
Common concerns include:-
* Loss of Employment.
Many people are anxious that making a work accident claim against their current employer will result in their loss of employment. However, there are laws in place to prevent this sort of situation from happening, meaning you will not lose your job. If your employer does act inappropriately and terminate your employment, we can advise you on how to claim for unfair dismissal.
* Deductions From Your Compensation.
If your claim is successful, you will be awarded a sum of compensation. This will cover your pain, suffering and loss of amenity (called 'General Damages') and for the financial losses you have sustained (called 'Special Damages'). The amount of compensation will be negotiated between your solicitor and the other side. Once an amount has been agreed, you will receive 100% it. There are no deductions; you are quite simply given all of your compensation. Your solicitor's fees will then be paid by the other side - usually your employer's insurance company.
* Losing a Claim.
We often get asked what happens if a claim is lost, as understandably people do not want to run the risk of paying a hefty bill. However, you can rest assured that even if you do lose your claim, you will not pay anything. This is because our insurers will cover the costs, meaning you do not have to fork out a single penny.
* Hidden Costs.
When you make a claim with Work Accident Solicitors, we promise you will not encounter any nasty surprises when it comes to hidden costs. We are open and honest with all our clients from the beginning, and your solicitor will explain how the process will work in terms of finances at the start of your claim. But put simply, you will not pay anything if you win your claim, and you will not pay anything if you lose your claim.
